Terms of Service / Terms of Sale (Minxa Art)

These Terms of Service/Terms of Sale ("Terms") govern your use of minxa.art (the "Site") and any purchase of products from our Shopify store. By accessing the Site or placing an order, you agree to these Terms and the policies referenced below. If you do not agree, do not use the Site or place an order.

Policies (part of these Terms)


If these Terms conflict with a policy, the more specific policy controls for that topic.

1) Products and accuracy

We sell physical products only. Some items are made-to-order and/or personalized. Product photos are illustrative; colors/materials may vary due to screen settings and the handmade nature of products.


You are responsible for verifying your selections and personalization details before checkout. We are not responsible for errors caused by incorrect information you submit.

2) Orders and acceptance

Placing an order is an offer to buy. We may accept or reject any order at our discretion (including for suspected fraud, inventory issues, shipping limitations, or pricing errors).


A contract is formed only when we confirm acceptance (typically by sending a fulfillment/shipping confirmation or otherwise confirming dispatch/fulfillment).

3) Prices and payment

Prices and availability may change at any time. The price charged is the price shown at checkout at the time you place the order.


You authorize us (and our payment providers) to charge your payment method for the total shown at checkout, including shipping and any applicable taxes shown.


If we discover a pricing error, we may cancel and refund your order or contact you to proceed at the corrected price.

4) Worldwide shipping; delivery; customs

We intend to ship worldwide, but shipping availability depends on destination, carrier availability, and legal restrictions. We may be unable to ship to certain countries/regions.


Delivery times are estimates only and not guaranteed. Delays may occur due to carriers, customs, weather, peak periods, or events outside our control.


Customs/VAT/import fees: For international shipments, you are responsible for customs duties, import taxes, and local fees unless we explicitly state otherwise at checkout.


Risk: For EU consumers, risk generally passes when you (or a person you nominate) takes physical possession of the goods. For non-EU sales, risk may pass to you when the parcel is handed to the carrier, to the extent permitted by law.

5) Returns, refunds, and EU withdrawal rights

If you are an EU consumer, you may have a 14-day right of withdrawal for eligible non-custom goods, subject to applicable law.


Made-to-order/personalized items: The right of withdrawal generally does not apply to goods made to your specifications or clearly personalized, except where required by law or where items are defective/non-conforming.


If your item arrives defective, damaged, or incorrect, contact us and we will handle it under the Refund Policy and applicable consumer law.

6) Intellectual property

All Site content (including images, text, designs, logos) is owned by Minxa Art and/or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or use our content for commercial purposes without written permission.

7) Feedback and reviews

If you submit reviews, messages, images, or other content ("Feedback"), you grant us a worldwide, perpetual, royalty-free, sublicensable license to use it for operating and promoting the business (e.g., on the Site and social media), unless prohibited by law. You confirm you have the rights to submit such Feedback.

8) Prohibited use

You may not use the Site for unlawful purposes, fraud, harassment, infringement of rights, scraping, spamming, or introducing malware. We may restrict or terminate access for violations.

9) Third-party services and links

The Site may include third-party tools or links. We are not responsible for third-party content, policies, or services.

10) Shopify relationship

Minxa Art is powered by Shopify, which enables us to provide the Services to you. However, purchases in our store are made directly with AVT Gemini Agency SRL (Minxa Art). Shopify is not responsible for any aspect of sales between you and Minxa Art. To the fullest extent permitted by law, you release Shopify and its affiliates from claims arising from purchases and transactions with Minxa Art.


11) Disclaimers and liability

Nothing in these Terms limits mandatory consumer rights under applicable law.

To the fullest extent permitted by law, we are not liable for indirect or consequential damages. We do not exclude liability where exclusion is not permitted by law (including liability for death/personal injury caused by negligence, fraud, or mandatory consumer remedies for defective goods).


12) Governing law

These Terms are governed by the laws of Romania. If you are an EU/EEA/UK consumer, you may also have mandatory rights under the laws of your country of residence.
